JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Bhargama P.S. Case No. 63 of 2016 registered for the offences punishable under Sections 341, 323, 379, 354 (B), 324, 307, 504, 506/34 of the Indian Penal Code.

As per the first information report, the allegation against the petitioner is that he assaulted with Farsa to Anil Mehta, the son of the informant, twice causing injury on head and left hand. Submission is of false implication and that due to land dispute the petitioner and others have been implicated, no offence under Section 307 IPC is made out, offence under Section 379 IPC is not made out and as such the petitioner deserves sympathetic consideration.

Patna High Court Cr.Misc. No.22209 of 2017 (3) dt.01-07-2017 Learned APP opposes the prayer of pre-arrest bail by submitting that he has caused head injury to Anil Mehta. In the facts and circumstances stated above, considering the allegation attributed against the petitioner, this Court is not persuaded to grant the privilege of pre-arrest bail to the petitioner, accordingly, his such prayer stands rejected.
