The petitioner seeks bail in a case registered under Sections 395, 397, 412 of the Indian Penal Code. Allegation is that 20 unknown dacoits on gun point looted jewellery of Rs.36 lakhs and cash Rs.2 lakhs and they also took away 5 mobiles.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.6.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. So far recovery is concerned, no incriminating articles is said to have been recovered. So far
Patna High Court CR. MISC. No.58612 of 2019(3) dt.16-11-2019 2/2 mobile, motorcycle and chain are concerned, same belongs to the petitioner.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Mahua P.S. case No.207 of 2019.
