In this case, the petitioner is seeking anticipatory bail in connection with Deoria P.S. Case No.5 of 2017, registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and under Section 25(1-b) a 26, 35 of the Arms Act.
The Police on the basis of secret information has raided the place, from where two persons, namely, Rupesh Kumar and Suraj Kumar were arrested and the petitioner taking the benefit of darkness fled away from there. Learned counsel for the petitioner submits that the name of the petitioner has come on the basis of the statement of Mukesh Kumar.
Patna High Court Cr.Misc. No.23573 of 2017 (3) dt.22-08-2017 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. If the petitioner surrender before the Court below within four weeks from today and prays for bail, the Court below will pass the order in accordance with law on the same day without being influenced by the order of this Court.
