JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.
Allegation is that three motorcycle borne criminals looted away Rs.20,000/- and other belongings of informant. It has been submitted on behalf of petitioner that he has falsely been implicated in the present case. He is in custody since 19.8.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. He is not named in the F.I.R. He has been made accused on the basis of confessional statement of co-accused. There is no recovery of any incriminating article from possession of petitioner. He has not been put on T.I.P.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
