JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner wants to renew his prayer for bail, which was earlier rejected vide order dated 12.05.2016 passed in Criminal Misc. No. 14051 of 2016, on the ground that the petitioner is in custody since long, the trial has not been concluded within the stipulated period and the petitioner was given liberty to renew his prayer for bail and as such, now the petitioner deserves sympathetic consideration. The recovered amount does not tally with the theft amount.

The learned A.P.P submits that the petitioner has got criminal antecedent and on the basis of CCTV footage he has been

In the facts and circumstances stated above, considering detention of the petitioner and further that the trial has not been concluded within the stipulated period and as such now the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of Railway Magistrate, Samastipur in connection with Samastipur Rail P.S. Case No. 03 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
