JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-09-2019 The petitioners apprehend their arrest in connection with Supaul P. S. Case No. 163 of 2019 registered under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation against the petitioners is that daughter of the informant was abducted by Santosh Kumar and Sanjay Kumar and petitioners are family members of them.

Learned counsel appearing on behalf of the petitioners submits that petitioners have unnecessarily been dragged in this case inasmuch as there was love affairs in between co-accused Santosh Kumar and daughter of the informant and she was rescued by the police and her statement under Section 164 Cr.P.C. has been recorded, which has been brought on record by the Learned counsel for the petitioner by way of supplementary

Patna High Court CR. MISC. No.60788 of 2019(2) dt.25-09-2019 2/2 affidavit. Learned counsel, relying upon the statement of the victim girl, submits that the victim girl has categorically stated that she has performed marriage with Santosh Kumar without any pressure from the petitioners and they have been living as husband and wife in Delhi.

Having regard to the submissions made by the parties and taking into consideration the fact that in her statement recorded under Section 164 Cr.P.C., the victim girl has not stated anything against the petitioners and the petitioners are family members of co-accused Santosh Kumar, I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, Supaul in connection with Supaul P.S.Case No. 163 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
