Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.
Ajit Kumar Singh, who happens to be ACJM while was in a way to Behea Bazar from his house along with his bodyguard and reach near Middle School, Urmila Devi (a Mukhiya candidate), her husband, Tej Narayan along with Ramaswami, Bhola Yadav, Krishna Bihari, two sons of Tej Narayan Singh (name not disclosed), Shayam Bihari Singh, Kripa Singh, Nandan Singh, Chotan Singh (petitioner), Veera Yadav (petitioner), bodyguard of Krishna Bihari Singh along with 10-12
Patna High Court Cr.Misc. No.19 of 2017 (3) dt.02-02-2017 unknown persons apprehended Ajit Kumar Singh and began to assault, over which the informant along with others rushed in rescue but, during midst thereof, they were forbidden and during course thereof, the accused persons began to fire. Bhola, Tej Narayan and his bodyguard were armed with firearms, rest were armed with Lathi and Bhala. During course of firing Bhola Yadav shot at his brother Anjani Kumar Singh over his head on account of which he died instantaneously. No specific role has been assigned against the petitioners who are under custody since long. Accordingly, petitioners Veera Yadav and Chhotan Singh each are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Third Additional Sessions Judge, Bhojpur at Ara in connection with Sessions Trial No.392/2016 arising out of Behea P.S.
