In the present case, petitioner is challenging the order dated 11.5.2015 passed by the Sub Divisional Officer, Kishanganj by which he has cancelled his licence for running a P.D.S shop.
Earlier against the order of cancellation the petitioner has moved before this Court vide C.W.J.C. No.617 of 2015 but the case was remanded back to re-consider the matter after giving reasonable opportunity of hearing to the petitioner. Accordingly the petitioner was given chance to file show cause and after completion of the same the order
Patna High Court CWJC No.4638 of 2016 (2) dt.08-08-2017 has been passed.
The petitioner, if so advised, may file appeal before the appellate authority within three weeks from today. If the petitioner files appeal within the aforesaid period, the Collector, Kishanganj will dispose of the same within a period of three months from the date of filing of the appeal. While disposing of the limitation matter the Collector will take into account the pendency of the present case before this Court. This Court is not giving any opinion on the merit of the case.
With the aforesaid observations and directions this writ petition is disposed of.
