The petitioner apprehends his arrest in connection with Barachatti (Mohanpur) P.S. Case No. 82 of 2022 registered under Sections 420 and 409 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has paid an amount of Rs. 19,700/- to Anchal Nazrat, Mohanpur (Annexure-3). He also deposited an amount of Rs.1,56,600/- vide bank draft no. 614225 dated 31.05.2022 to Circle Officer, Mohanpur (Annexure-5 & 5A). It is also submitted that petitioner is an old aged person and has 100% blockage in one valve and 80% blockage in another valve in his
Patna High Court CR. MISC. No.61886 of 2022(4) dt.19-01-2023 2/2 heart (Annexure-8 series). Petitioner has clean antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Chief Judicial Magistrate, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 82 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
