The petitioner apprehends his arrest in a case registered for the offence under Section 302 / 34 of the Indian Penal Code.

In the F.I.R., it is alleged that all the accused persons including this petitioner killed sister of the informant by pressing her neck due to family /domestic dispute. It is submitted on behalf of petitioner that petitioner is Devar (brother-in-law) of the deceased and has got no concerned with the affairs of deceased. He is separate in mess and property. It is further submitted that during course of investigation, it has come that two sons of deceased categorically stated that the deceased committed suicide. It is further submitted that similarly situated co-accused persons

Patna High Court CR. MISC. No.62168 of 2022(2) dt.20-03-2023 2/2 have already been granted anticipatory bail by coordinate Benches of this Court, vide order dated 10.01.2023 passed in Cr.Misc. No. 34896/2022 and order dated 14.03.2023 passed in Cr.Misc. No. 36447/2022 respectively. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned I/c Chief Judicial Magistrate, Nawada in connection with Muffasil (Nawada) P.S. Case No. 132 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
