This is a petition for grant of anticipatory bail for offence under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Allegation against the petitioners is that petitioner produced a forged certificate of B.Ed. pass and got appointment on the post of teacher.

Submission of the petitioner is that though some leniency was allowed to such aspirants in some writ applications, who will submit their resignation within the stipulated time, but, the petitioner did not submit his resignation in bonafide belief. However, the petitioner submits that he has already been removed. Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand)

Patna High Court Cr.Misc. No.53108 of 2016 (4) dt.28-01-2017 2/2 with two sureties of the like amount each in connection with Samastipur Town P.S. Case No. 176 of 2016 to the satisfaction of the Chief Judicial Magistrate, Samastipur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
