JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Phulwariya P.S. Case No. 191 of 2022, registered for the offences punishable under Section 326(A) of the Indian Penal Code.

As per allegation, the sleeping of the informant was interrupted by the cry of her daughter Kajal Kumari. She rushed there and her daughter apprised that someone after, throwing acid, fled away from there. The victim died during course of treatment.

The learned counsel for the petitioner has submitted that he is not named in the FIR and has falsely been implicated

On the other hand, the learned APP has opposed the prayer for bail and submitted that the fardbeyan of Kajal Kumari was taken and she has named the petitioner. The petitioner has also confessed his guilt.
