JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 324 of 2016 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506,379 and further added 302 (20.12.2016) I.P.C. and 25(1-b) a/26/27 Arms Act.

The allegation leveled against the petitioner is with regard to him and other co-accused persons coming into the field of the informant and others and entering into an altercation with the informant and others on account of land dispute. It has been further alleged that so far as the petitioner is concerned, he had fired from his rifle, resulting in the same hitting four persons.

No.24250 of 2017 (3) dt.13-06-2017 2/2 The learned counsel for the petitioner has submitted that so far as the said four persons, who are said to have been hit by gun shot fire of the petitioner are concerned, they have in fact not received any gunshot injury, as is apparent from the injury report.

It is further submitted that the petitioner has got no criminal antecedent. The learned counsel for the petitioner also submits that some other co-accused persons have been granted bail. It is the submission of the learned counsel for the petitioner that so far as the petitioner is concerned, he has not given any lathi blow on the person of the deceased.

Having regard to the facts and circumstances of the case, I find that this is a fit case in which the petitioner should be released on bail.

Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XI, Bhojpur (Ara) in connection with Jagdishpur P.S. Case No.- 324.
