JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 The petitioner seeks regular bail in connection with Mahua P.S. Case No. 365 of 2019, registered for offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation as per F.I.R. is that police received the information of carrying huge quantity of liquor by a truck and the same was unloaded to the vehicle of the petitioner as well as to the vehicle of other accused persons and from the vehicle of the petitioner, huge quantity of liquor was recovered. It has been submitted on behalf of the petitioner that he has already sold the vehicle in the year 2016 and he has produced the paper regarding that before the police but the same was not investigated and petitioner has been in custody for five months and other accused persons having similar allegation has

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Excise Court, Vaishali, Hajipur, in connection with Mahua P.S. Case No. 365 of 2019 subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court.
