ANJANA PRAKASH ORAL JUDGMENT Date: 08-02-2016 The Petitioner seeks clarification of the order dated 09.04.2015 passed in Cr. Rev. No. 197 of 2015 by which this Court had refused the prayer for release of the Petitioners and directed that proper inquiry be conducted in regard to Petitioner No. 2, Vishal @ Vishal Kumar @ Golu in connection with Aurangabad Town P.S. Case No. 229 of 2014. The Petitioner who was the victim had brought to light the fact that both the accused had manipulated fake papers in regard to their schooling upon which this Court had directed a medical report in respect to co-accused. The Court, however, rejected the prayer with regard to Ankit Gupta, Opposite Party No. 2 and got conducted the Medical Board
Patna High Court CR. REV. No.916 of 2015 dt.08-02-2016 only with regard to Vishal Kumar on the ground that this Court did not so direct.
The Juvenile Justice Board, Aurangabad was expected and is directed to apply its mind independently to all aspects and thereafter pass an order in accordance with law so that no party is in any manner prejudiced in respect to Ankit Gupta @ Ankit Kumar Gupta within a period of three weeks from the date of receipt of this order. With the aforesaid observations, the Application stands disposed off.
