The petitioner seeks bail in connection with Khanpur P.S. Case No. 49 of 2016 registered under Section 47(A) of the Excise Amendment Act 2016.
In course of patrolling duty, the informant got information regarding the sale of country made wine at the residence of the petitioner and other co-accused. The police conducted raid and seized 5 lts. country made wine while it was being prepared on the oven.
Learned counsel for the petitioner submits that nothing was recovered from the house of the petitioner, moreover, in presence of any of the family members. The petitioner has clean antecedent and he remained in custody for more than six months.
Patna High Court Cr.Misc. No.3053 of 2017 (4) dt.29-03-2017 2/2 Learned APP, on the other hand, opposed the submissions.
Considering the nature of allegation and the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Samastipur in connection with Khanpur P.S. Case No. 49 of 2016. (Sanjay Kumar, J) rohit/- U T
