Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends arrest in connection with Narpatganj (Ghurna) P.S. Case No. 342 of 2023 registered for the offences under Sections 366(A) & 34 of the Indian Penal Code.

Learned counsel for the petitioner submit that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the statement of the victim recorded under Section 164 of the Cr. P.C. reveals that she is 18 years old. She does not want to go with her parents and had married the petitioner on her own sweet will as contained at Annexure -P2, P3 & P4 of the bail application. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of C.J.M., Araria in connection with Narpatganj (Ghurna) P.S. Case No. 342 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
