JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-11-2017 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned A.P.P. for the State.. The petitioner apprehends his arrest in connection with Beur Case No. 295/2016 for the offences punishable under Section 302 of the Indian penal Code.

The accusation is of killing the daughter of the informant, by her husband Pushpendra Kumar @ Chhotu (petitioner) in drunken state due to non fulfillment of cash Rs. five lacs.

Learned counsel for the petitioner submits that the petitioner, whose marriage was performed with deceased in the year, 2007 has been falsely implicated in this case.

Patna High Court Cr.Misc. No.24766 of 2017 (5) dt.14-11-2017 2/2 In the Post Mortem report double ligature mark were found on the neck of deceased.

Having considered the facts and circumstances of the case and nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to him and accordingly, his prayer for anticipatory bail is rejected.
