JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2020 The petitioner seeks regular bail in connection with Excise Case No. 227 of 2019, registered for offences punishable under Section30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 5097 litres of foreign liquor form the truck and petitioner was arrested on spot along with others and he was said to be one of the drivers. It has been submitted on behalf of the petitioner that he has nothing to do with the alleged recovery and has falsely been roped in the present case. He is only a driver and has been in judicial custody since 07.07.2019 and another driver has already been enlarged on bail by coordinate Bench of this Court. Heard learned A.P.P. also.

No.58105 of 2019(3) dt.07-01-2020 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum-Special Judge, Excise, Gopalganj, in connection with Excise Case No. 227 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.

Before releasing the petitioner on bail, the court below is directed to verify the address of the bailors as well as that of the petitioner.
