2. The petitioner has preferred this application for grant of regular bail in connection with Runnisaidpur P.S. Case No. 373 of 2023 dated 17.07.2023 registered for the offence punishable under Sections 30(a), 32(i)(ii), 36 and 41(i)(ii) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, total 1921.50 litres of foreign liquor was recovered from the container (Truck) which was driven by the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has clean antecedent, as stated in

Patna High Court CR. MISC. No.64978 of 2023(2) dt.12-10-2023 2/2 paragraph no. 3 of the bail petition. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not the owner of the seized vehicle rather he is a driver. He had no knowledge regarding the seized article. He is in custody in this case since 18.07.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 373 of 2023.

7. The application stands allowed.
