The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273, 414/34 of the Indian Penal Code and section 47a of the Excise Act.

It is alleged that 1900 sachets of country made liquor were recovered from the Maruti-800 wherein three persons were sitting out of which one Sanjay Kumar known to the informant from before. Co-accused Sanjay Kumar named co-accused Sunil Choudhary, who subsequently, named the petitioner as his associates.

It is submitted by learned counsel for the petitioner that admittedly no recovery has been made from the petitioner

Patna High Court Cr.Misc. No.54195 of 2015 (2) dt.30-11-2015 2/2 and his name sprang up after about a year of investigation of the case.

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Tharthari P.S. Case No.18 of 2014, pending before the learned CJM, Nalanda at Biharsharif.

With the above observation, this application is, accordingly, disposed off.
