The petitioner is in custody since 07.07.2019 in connection with Excise Case No. 227/2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were made from the truck. It is further submitted that the petitioner has nothing to do with what material is loaded in the cartons and inside the cartons which come to be loaded on the truck which he is deputed to drive. It is thus submitted that the petitioner being not in conscious possession of such items may be extended the privilege of bail. It is further submitted that the petitioner has got no criminal

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Excise, Gopalganj, in connection with Excise Case No. 227/2019.
