The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 120B/304B/328/34 of the Indian Penal Code.
The petitioner is father-in-law of victim Nikki Devi, who died within seven years of marriage in her matrimonial house in unnatural circumstances. There is allegation of demand of dowry and torture soon before her death.
Allegation is that the victim was poisoned to death for non-fulfilment of the dowry demand. Other witnesses have supported the allegation of demand of dowry and torture for the same.
Patna High Court Cr.Misc. No.22549 of 2017 (3) dt.01-07-2017 2/2 Submission of the learned counsel for the petitioner is that there is delayed reporting of the case to the police almost about fifteen days after the occurrence.
Considering the presumption of law against the petitioner, I am not inclined to grant anticipatory bail to the petitioner in connection with Simultalla Police Station Case No.38 of 2016, pending in the Court of learned Chief Judicial Magistrate, Jamui/Successor Court. Accordingly, the prayer for anticipatory bail is refused.
