2. Heard learned counsel for the petitioner and learned A.P.P for the State.

3. The petitioner has preferred this application for grant of regular bail in connection with Laukahi P.S. Case No. 20 of 2023 corresponding to G.R. No. 112 of 2023 dated 21.01.2023 registered for the offences punishable u/ss 447, 448, 341, 323, 307, 354(B), 379, 504 and 506 read with section 34 of the Indian Penal Code.

4. As per the prosecution case, the petitioner and the co-accused persons along with two unknown miscreants came

When the informant demanded money for articles, the petitioner refused and the co-accused Rupesh Kumar Yadav started assaulting his wife with legs and fists and put pistol on her temple. When the other family members of the informant came to rescue, they also assaulted them with sharp weapons causing injuries to them. It is further alleged that the co- accused Rupesh Kumar Yadav disrobed her wife and one Rajan Kumar Yadav snatched silver chain from the informant's wife.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. As per the injury report, all the injuries are simple in nature. The petitioner has 12 other criminal cases and he is on bail in 11 criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 27.03.2023.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of

Patna High Court CR. MISC. No.64941 of 2023(2) dt.12-10-2023 3/3 the like amount each to the satisfaction of learned Court concerned, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 20 of 2023 corresponding to G.R. No. 112 of 2023, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to cancelled. (ii). If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.
