Petitioner is languishing in custody since 19.01.2017 in connection with Paroo P.S. Case No. 13/2017 for offences punishable under Section 414 of the Indian Penal Code, 25(1-b)a, 26/35/25(1-A), 25(1-AA), 25(1AAA) of the Arms Act, 3⁄4 of the Explosive Substance Act and 16, 17, 18, 18A, 19, 20 and 21 of the UAP Act. The prosecution case, as lodged by the informant, is that some members of Naxal organization have proposed to convene a meeting at Panchayat Bhawan, but the police officials reached the place, on which some persons fled away, while six persons were apprehended.

No.23433 of 2017 (2) dt.23-06-2017 2/3 It has been submitted by the learned counsel for the petitioner that he is innocent, has falsely been implicated in the aforesaid case, nothing has been recovered from the possession of the petitioner and it is only on the basis of confessional statement of other co-accused that his name surfaced. It is submitted that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence. It is further submitted that other co-accused have been granted the privilege of bail by Coordinate Bench of this Court in Cr. Misc. No. 22793 of 2017 on 19.05.2017 and in Cr. Misc. No. 22936 of 2017 on 23.05.2017 and the case of the petitioner is on better footing.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum- Special Judge, Muzaffarpur, in connection with Paroo P.S. Case No.13/2017, subject to the condition that both the bailors
