JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 Petitioner seeks bail in connection with Excise Case No. 09 of 2019, registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. As per F.I.R. there is recovery of the truck, from which foreign liquor was recovered and one person was arrested, who disclosed the name of the petitioner, as the person who succeeded in fleeing away. Apart from that, he is accused in one more case, in which he has been granted bail. Submissions of the learned counsel for the petitioner is that only on confessional statement of the coaccused, he has made accused in this case. He is in custody since 07.08.2019 and other accused persons, who have been arrested at the spot, have been granted regular bail, vide order

Having heard both sides, considering the submissions, made above, this application is allowed. Let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Sheikhpura, in connection with Excise Case No. 09 of 2019 arising out of Barbigha P.
