The Petitioners seek bail in Baikunthpur P.S. case No.30 of 2016 instituted for the offence under Sections 304B/34 of the Indian Penal Code, pending in the court of learned 3rd A.C.J.M., Gopalganj Allegation is that the accused persons including the petitioners killed the cousin sister of the informant due to nonfulfilment of dowry. It has been submitted on behalf of the petitioners that the petitioners are in custody since 2.8.2016 and 17.8.2016 respectively. The husband of the deceased has not been made

Patna High Court Cr.Misc. No.51398 of 2016 (4) dt.16-01-2017 2/2 accused in the present case. The petitioner No.1 is the father-inlaw and petitioner No.2 is the brother-in-law (Devar) of the deceased.

A report was called for from the Trial Court regarding the stage of the case and within what period the trial is expected to be concluded. The same is at Flag 'B'.

It has been reported that out of eight witnesses two prosecution witnesses have already been examined and the trial is expected to be concluded within a period of three months. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioners at this stage. The same is rejected. The trial court is directed to take all necessary steps to conclude the trial preferably within a period of four months from the date of receipt/production of a copy of this order.
