The petitioner is accused in connection with Laxmipur P.S. Case No. 48 of 2016 registered under Section 147, 148, 149, 302, 307 and 364 of the Indian Penal Code.

The accusation is that 11 persons named of the First Information Report including the petitioner entered into the house of the informant and carried the informant and his son Birendra Bind towards Paswan Toli. Co-accused Jitendra Paswan assaulted by Tangi at the head of the informant and co-accused Amrit Paswan gave sword blow at the leg of the informant and the petitioner Bhuto Paswan gave lathi blow causing injury to him. Birendra Bind, son of the informant was also assaulted by all

Patna High Court Cr.Misc. No.23180 of 2017 (2) dt.18-05-2017 2/2 accused persons including the petitioner.

Learned counsel for the petitioner submits that there is general and omnibus allegation against the present petitioner to have caused injury to the informant and his son Birendra Bind. It is further submitted that similarly situated coaccused, Jitendra Paswan and Amrit Paswan have already been granted privilege of bail by this Court vide order dated 23.02.2017 and 26.09.2016 passed in Criminal Miscellaneous Nos. 8047 and 27582 of 2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, Additional Chief Judicial Magistrate-III, Jamui in connection with Laxmipur P.S. Case No. 48 of 2016, subject to the condition that out of two sureties, one surety must be the close relative of the petitioner.
