1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Bettiah (Town) P.S. Case No. 259 of 2023 registered under Sections 420, 406, 468, 471 and 120B of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioner submits that similarly situated several co-accused persons have already been allowed bail by different Benches of this Court vide Cr. Misc. Nos. 60706 of 2023 and 63545 of 2023 on 11.10.2023 and 17.10.2023 respectively.
4. Taking into consideration the above facts and circumstances of the case, let the above named petitioner be
Patna High Court CR. MISC. No.68128 of 2023(2) dt.01-11-2023 2/2 released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bettiah, West Champaran in connection with Bettiah (Town) P.S. Case No. 259 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C. with following conditions: (i) That one of the bailors will be a close relative of the petitioner who will file an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the court if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
