The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 324, 326/34 of the Indian Penal Code and Section 27 of the Arms Act. According to FIR, the informant saw that his brother has sustained firearm injury near pinea. The brother disclosed the name of seven accused persons and seven unknown to have committed the crime alleged.
It appears that co-accused Dabloo has already been allowed anticipatory bail by a co-ordinate Bench of this Court vide order dated 22.10.2016 passed in Cr. Misc. No.44352 of 2016. Considering the aforesaid facts as well as the fact that there is no material to substantiate that the petitioner is not going
Patna High Court Cr.Misc. No.52515 of 2016 (3) dt.10-02-2017 2/2 to co-operate with the investigation of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna/Successor Court in connection with Barh Police Station Case No. 272 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
