2. The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 149, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act and Sections 3/4 of the Explosive Substances Act registered in connection with Pakribarawan (Dhamaul) P.S. Case no. 126 of 2014.
3. It is submitted that the petitioner has been falsely implicated as evident from the first information report, despite alleged indiscriminate firing by the accused persons, no injury has been sustained by anybody. Similarly situated co-accused Naresh Yadav has been granted anticipatory bail by a Bench of this Court in Cr. Misc. No. 30346 of 2015.
4. Having regard to the entirety of the facts and
Patna High Court Cr.Misc. No.52311 of 2015 (2) dt.09-11-2015 2/2 circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawadah in connection with Pakribarwan (Dhamaul) P.S. Case No. 126 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
