This application has been filed by the petitioner for modification of order dated 28.01.2015 passed in Cr. Misc. No. 17216 of 2014 praying for extension of time to surrender and furnish the bail bond in the court below.

The anticipatory bail of the petitioner was allowed vide order dated 28.01.2015. He is husband of the informant. There is matrimonial dispute between the parties. The condition of grant of anticipatory bail was that the petitioner shall pay Rs. 1,000/- per month regularly for the benefit of informant's sister. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.6364 of 2023(3) dt.22-03-2023 2/2 that petitioner is ready to deposit the entire arrear of amount in the court below.

If the petitioner adheres to his words and deposits the entire arrear of amount in the court below, then in the event of his surrender within one month, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Mahila P.S. Case No. 24 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The learned court below shall hand over the entire amount deposited by the petitioner to the sister of the informant (victim girl).

With these observations, the petition is disposed of. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
