JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-06-2017 Heard learned counsel for the petitioner and learned counsel for the State.

This is an application for grant of anticipatory bail in connection with Bhagwan Bazar PS case no. 25 of 2017 registered for the offences punishable under Sections 307, 254(B) and allied sections of Indian Penal Code.

The allegation leveled against the petitioner and others is with regard to an altercation having taken place between the accused persons and informant and others on account of a land dispute.

Learned counsel for the petitioner submits that there is no specific allegation of overt act as far as petitioner is concerned. Petitioner is the young boy who is pursuing his studies

Patna High Court Cr.Misc. No.23576 of 2017 (2) dt.15-06-2017 and in support of it, his admit card is annexed with the bail petition. Learned counsel further submits that the injury report is on record which shows that injuries are simple in nature. Learned counsel further referred to the counter case being instituted on the same day. It is further submitted that there is no criminal antecedent as far as petitioner is concerned. Having regard to the facts and circumstances of the case, more particularly, the fact that petitioner is a young boy pursuing his studies, there is no specific allegation against him and that he has got no criminal history, I deem it fit and appropriate to enlarge the abovenamed petitioner on anticipatory bail on furnishing bonds of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Bhagwan Bazar PS case no. 25 of 2017 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
