2. The petitioners apprehend their arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 44 liters of illicit foreign liquor has been recovered from a motorcycle, which was parked at Domwa ghat near Chamar Devi Asthan.

4. Learned counsel for the petitioners submits that petitioners are neither owner nor driver of alleged motorcycle and have got no concern with the alleged recovery. No incriminating article has been recovered from the conscious

Patna High Court CR. MISC. No.67219 of 2024(2) dt.08-10-2024 2/2 possession of these petitioners and have been made accused in this case only on suspicion. Petitioner no. 1 has got clean antecedent, whereas petitioner no. 2 has got no criminal antecedent of similar nature.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Judge, Excise, Saran in connection with Sonepur P.S. Case No. 608 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
