JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 370/34 of the I.P.C. and 79 J.J. Act. Allegation against the petitioner is that he was carrying two children for labour work.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.1.2017 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The full brother of the victim has filed a petition that the victim was going to meet his relatives at Mumbai. Same is evident from Annexure-2 to the present application. The other co-accused has been granted bail
Patna High Court Cr.Misc. No.23419 of 2017 (2) dt.24-05-2017 2/2 vide Annexure-3 to the present application.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. (Railway), Samastipur in connection with Rail Darbhanga (Sitamarhi) P.S. case No.06 of 2017. (Sudhir Singh, J) Narendra/- U T
