The petitioners are apprehending arrest in a case registered for the offences punishable under sections 323,504,379 and 427/34 of the Indian Penal Code.

It is alleged that the petitioners of village Girdharia came, assaulted the informant and pulled the informant out from the car and took away forty thousand cash and gold chain. It is submitted by the learned counsel for the petitioners that the FIR was registered on 8.7.2015 which reached to the court of the learned Judicial Magistrate on 13.7.2015 which suggests that the FIR was registered by antedating. Patna High Court Cr.Misc. No.54151 of 2015 (2) dt.30-11-2015 2/2 submitted that in the background of dispute with regard to parking of vehicle the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Shivsagar P.S. Case No. 178 of 2015 pending in the court of learned CJM, Rohtas at Sasaram. This application is disposed of with the aforesaid observation/direction.
