1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per allegation in the F.I.R, it is a case of commission of murder of son of the informant along with other unknown co-accused persons, out of previous enmities.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case due to previous enmities and his name surfaced during course of investigation on the basis of confessional statement of co-accused Suraj Kumar.

5. Further it is submitted by the learned counsel for

Patna High Court CR. MISC. No.65118 of 2023(2) dt.12-10-2023 2/2 the petitioner that the other co-accused has already been granted bail by a coordinate bench vide order dated 06.07.2023 passed in Cr. Misc. No. 39077 of 2023. Petitioner has got no criminal antecedent and languishing in judicial custody since 23.02.2023.

6. The application for bail is opposed by learned APP for the State.

7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M.- 1st Class, Danapur, Patna in connection with Shahpur P.S. Case No. 124 of 2023.
