Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Muffasil P.S. Case No.19 of 2017 registered under Sections 30, 35 and 38 of the Bihar Excise Amendment Act, 2016.

The accusation is that in course of search of the Bolero vehicle, 785 pouches, each containing 200 ml. country made liquor, was recovered from the same and in the aforesaid Bolero vehicle, the petitioner alongwith Pappu Kumar Singh and Rohit Kumar were found sitting.

No.24564 of 2017 (5) dt.19-07-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner is in custody since 15.01.2017 and the co-accused Pappu Kumar alias Pappu Kumar Singh has already been granted bail by a Bench of this Court vide order dated 19.04.2017 passed in Criminal Misc. No.14989 of 2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Muffasil P.S. Case No.19 of 2017.
