JUSTICE PURNENDU SINGH ORAL ORDER 29-01-2025 Heard Mr. Mritunjay Kumar, learned counsel appearing on behalf of the petitioners; Ms. (Dr.) Indiwar Kumari, learned APP for the State and Mr. Manish Kumar Singh along with Mr. Dharmendra Kumar Singh, learned counsels for the informant.

2. The petitioners seek pre-arrest bail in connection with Muzaffarpur Town P.S. Case No. 434/2024 registered for the offence(s) punishable under Sections 108/109/118/352/351(3)/287/308(3)/62/3(5) of BNS.

3. As per the allegation made in the FIR, the accused persons named therein including the petitioners have threatened the informant's husband and demanded Rs. 2 lakh to vacate his

Patna High Court CR. MISC. No.67308 of 2024(3) dt.29-01-2025 2/3 land and also threatened to file a case under SC/ST Act against the entire informant's family, as a result of which, her husband got depressed and set himself on fire in the D.M. office, resulting into his death.

4. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and have falsely been implicated in the present case. Petitioners have clean antecedent.

5. Learned counsel appearing on behalf of the informant has vehemently opposed the prayer for grant of prearrest bail and submitted that the deceased in his dying declaration has stated that the petitioners along with other coaccused have threatened and harassed him, as a result of which, he was forced to set himself on fire.

6. Learned APP for the State has also vehemently opposed the prayer for grant of pre-arrest bail.

7. Having considered the rival submissions made on behalf of the parties, as well as the nature of allegation made against the petitioners, I am not inclined to grant pre-arrest bail to the petitioners. Accordingly, the present bail application stands dismissed.

8. However, the petitioners, if so advised, may

In that case, the District Court is directed to consider the bail application of the petitioners on the same day and pass necessary order on the basis of material which has come in course of investigation without delay.
