This application is for grant of regular bail in connection with Chandramandih P.S.Case No.39 of 2011, for the offences under Section 395 of the Indian Penal Code.

The petitioner is not named in the F.I.R. but it appears that his name transpired during the course of investigation. It is submitted on behalf of the petitioner that neither anything has been recovered from the possession of the petitioner nor he has been put on T.I.P. and he is in custody for about three months, however, it is submitted on behalf of the petitioner that earlier the petitioner had moved for anticipatory bail in the year, 2015 and the same was rejected with direction to surrender before the learned court below within a period of six weeks but he did not

Patna High Court Cr.Misc. No.22970 of 2017 (2) dt.15-05-2017 2/2 surrender and now he is ready to abide by any condition imposed upon him.

Heard learned A.P.P. also.

Having heard both sides and in view of conduct of the petitioner, at this stage, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail before the learned court below after framing of the charge in this case.

With the aforesaid observation, this application is dismissed.
