JUSTICE SANDEEP KUMAR ORAL ORDER 18-09-2025 Heard learned counsel for the petitioners, learned counsel for the Mines Department as well as learned A.P.P. for the State.

2. The petitioners seek regular bail in connection with Banjaria P.S. Case No. 341 of 2025, registered for the offences punishable under Sections 303(2) and 111 of the Bharatiya Nyaya Sanhita, 2023, Section 56 of the Bihar Minerals Concession (Prevention of Illegal Mining, Transportation and Storage) Rules, 2024, and Section 421 of the M.M.D.R. Act, 1957.

3. As per the prosecution case, the petitioners are alleged to have been extracting sand.

4. Learned counsel for the petitioners submits that the petitioners are labourers and only engaged for extracting sand. They are in custody since 21.06.2025 and claim clean antecedents.

5. Learned A.P.P. and learned counsel for the Mines Department have vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran/ concerned Court below in connection with Banjaria P.S. Case No. 341 of 2025.
