The petitioner apprehends his arrest in connection with Halsi P.S. Case No. 142 of 2019, registered under Section 30(A) of the Bihar Excise Act.

The accusation is of recovery of two litres Mahua liquor from the Varandah of the house of the petitioner. Learned counsel for the petitioner submits that the Varamdah, from which, two litre Mahua liquor is said to be recovered, is joint house of the petitioner and the said Varamdah is easy accessible by any person and not circled with the wall and door. Case No. 142 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
