2. The present application has been filed seeking cancellation of the anticipatory bail granted to Opposite Party no. 2 vide order dated 02.08.2022 passed in Cr. Misc. No. 3017/2022 arising out of Ekangarsarai P.S. Case No. 148 of 2021, registered under Sections 341/ 323/ 379/ 498(A), 504/ 506/ 34 of the I.P.C. and Sections 3/ 4 of the Dowry Prohibition Act.
3. Learned counsel for the petitioner submits that the opposite parties have allegedly violated the condition of bail by not complying with the direction of this Court regarding
Patna High Court CR. MISC. No.68391 of 2023(15) dt.24-07-2026 2/2 payment of monthly maintenance to the petitioner.
4. Accordingly, the present application stands disposed of with liberty to the petitioner to approach the court below, by filing an appropriate application on the aforesaid ground.
5. If such an application is filed, the same shall be considered and decided by the learned Magistrate concerned, in accordance with law, within a period of 15 days from the date of its filing, after affording an opportunity of hearing to all concerned parties. In the event of non-cooperation by any party, the learned Magistrate shall be at liberty to proceed ex parte in accordance with law.
6. If the learned Magistrate finds the allegations of the petitioner to be true, the bail bond of the O.P. No. 2 shall be cancelled forthwith.
