Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek regular bail in connection with Marauna P.S. Case No. 64 of 2022 registered for the offences punishable under Sections 147, 149, 323, 325, 307, 379, 447, 504, 506, 324 and 384 of the Indian Penal Code.

As per the prosecution, the informant alleged that

Patna High Court CR. MISC. No.66808 of 2022(2) dt.16-03-2023 2/3 these petitioner along with co-accused and some unknown persons demanded extortion of Rs. 1Lakh. Further it is alleged that petitioners Bikram Ram and Jogendra Ram assaulted the informant by means of Lathi, Danda, Farsa etc.

The main submissions advanced by petitioners' counsel are that altogether ten named and five to seven unnamed persons were alleged to have committed the alleged occurrence and the main and specific allegation is against the co-accused Satyanarayan Ram and the allegations leveled in the FIR against the petitioners are general and omnibus and the petitioners were alleged to have assaulted the informant by means of Lathi, Danda and Farsa but on the person of the informant only two injuries have been found and the same have been opined to be simple in nature and in this regard Annexure-2 series filed by the petitioners along with this petition may be perused, though the injured namely, Ranjan Kumar Ranjan sustained incised wound but the same has also been opined to be simple in nature and the petitioners were not specifically alleged to have caused the said injury to the injured Ranjan Kumar Ranjan.

Further submissions are that the petitioners have fair and clean antecedent and petitioner No. 1 has been languishing in jail since 25.05.2022 and petitioner No.

Patna High Court CR. MISC. No.66808 of 2022(2) dt.16-03-2023 3/3 languishing in jail since 27.04.2022 and a previous land dispute in between both the parties is stated to be the genesis of the occurrence.

Learned APP appearing for the State has opposed the prayer for bail.

In view of the facts, as stated above as well as considering the nature of allegation appearing against the petitioners from the FIR, all the petitioners deserve to the privilege of bail. Accordingly, let all the petitioners namedabove be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Marauna P.S.
