JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Excise Case No. 138 of 2017 arising out of Dhangai P.S. Case No. 14 of 2017 instituted for the offence under Sections-30(a), 56(D) of Bihar Excise (Amendment) Act, 2016 of the Indian Penal Code. It is alleged that 8 bottles of Royal Stag foreign liquor containing 180 ml. each have been recovered from a motorcycle which was being driven by co-accused Raja Kumar. The said Raja Kumar disclosed the name of this petitioner before the police. The petitioner is said to be in custody since 25-03-2017. It has been submitted that co-accused Sonu Kumar has already been granted privilege of bail by a coordinate bench of this court by order dated 19-05-2017 passed in Cr. Misc. No. 24181 of

In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Excise Case No. 138 of 2017 arising out of Dhangai P.S. Case No. 14 of 2017) to the satisfaction of learned Additional Sessions Judge-IV, Ara, Bhojpur subject to condition that both the bailors should be close relatives of the petitioner.
