1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Piri Bazar P.S. Case no.81 of 2023 registered under sections 307, 147, 148, 149, 323, 324, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the accused persons are mafias illegally dealing in stones. It is stated that on the orders of D.F.O, Munger, a raid was conducted in the village on which the four named accused persons brutally assaulted the informant and his father.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Though he has been named in the F.I.R. amongst the six accused persons, however he is not named among the four persons

Patna High Court CR. MISC. No.66209 of 2023(2) dt.16-10-2023 2/2 against whom the allegation of assault is there. The petitioner is in custody since 13.7.2023 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R., his not being named as the accused persons who resorted to assaulting the informant or his father and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Piri Bazar P.S. Case no.81 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Lakhisarai.
