JUSTICE SHAILENDRA SINGH ORAL ORDER 16-09-2025 The instant writ application has been filed by the petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "(i) For issuance of an appropriate writ directing and commanding the respondents to declare the Bakast land of the petitioner pertaining to Thana no. 515, Khata no. 278, Khesra no. 314 area 61 decimal of Mauza Dewra, Circle Modanganj Jehanabad as a Raiyati land of the petitioner.

(ii) For issuance of an appropriate writ directing and commanding the respondents to give the petitioner all consequential benefits after declaring the aforesaid Bakast land of the petitioner as a Raiyati Land. (iii) For any other relief or reliefs of which the petitioner is legally entitled to."

2. The main grievance of the petitioner is that he has made repeated prayers before the DCLR, Jehanabad, for declaring about 61 decimals of his land as Raiyati land. It is submitted by the petitioner's counsel that the said land is the ancestral property of the petitioner, out of which around 13 decimals land has been acquired. For the remaining portion of his ancestral land, rent receipts are being issued in favor of the petitioner and the Jamabandi is also in his favor. To redress his grievance, the petitioner has also approached the District Magistrate, Jehanabad, vide Annexure P/8, however, no action has been taken to redress his grievance.

Considering the aforesaid submissions and taking into account the averments made in the writ petition as well as the annexures enclosed therewith, the DCLR, Jehanabad (Respondent No. 3), is hereby directed to look into the petitioner's aforesaid representations and take necessary legal action within six weeks from the date of receipt of a copy of this order. The action taken step shall be communicated to the petitioner in writing.

4. Petitioner will have a liberty to produce AnnexureP/1 before the DCLR, Jehanabad (Respondent No.3) by way of a fresh application as according to him, his matter is based on

5. Accordingly, with above direction the instant writ petition stands disposed of.
