JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code.

The prosecution case is that on 23.08.2015 at 5:30 A.M the informant was going to catch train through Chanel river bridge when the F.I.R named accused persons including the petitioner surrounded him. The co-accused Bharat Mahto assaulted by means of Farsa upon the head of the informant whereas this petitioner assaulted by means of Khanti on abdomen. Co-accused Snehi Mahto and Bharat Mehto assaulted with lathi to the informant and snatched cash of Rs. 5000/- of the informant.

It is submitted by learned counsel for the petitioner that injury report does not suggest any injury on the abdomen. Moreover the injury has been found to be lacerated,

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Kashi Chak P.S. Case No. 68 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
