The petitioners are languishing in custody since
Patna High Court CR. MISC. No.62759 of 2019(3) dt.25-10-2019 2/3 25.06.2019 in a case registered for the offence punishable under Section 414/34 of the Indian Penal Code. It is alleged that the police during patrolling intercepted a motorcycle on which three persons were riding, but on demand, no paper could be produced by them with respect to the intercepted vehicle.
It is submitted by learned counsel for the petitioners that the petitioners have maliciously been framed in the present case. Moreover, the investigation has already been concluded and a statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent.
Learned APP for the State submits that the stolen motorcycle has been recovered from the possession of the petitioners.
Considering the fact that investigation has already been concluded, coupled with statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi, in connection with
Patna High Court CR. MISC. No.62759 of 2019(3) dt.25-10-2019 3/3 Riga P.S. Case No. 175 of 2019.
