1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The present application has been filed for modification of the order dated 24.01.2024 passed in Cr. Misc. No. 180 of 2024 whereby the present petitioner has been granted the privilege of anticipatory bail subject to the condition that the petitioner shall surrender before the learned court below within a period of four weeks from the date of order.

3. Learned counsel for the petitioner submits that earlier also Cr. Misc. No. 58592 of 2024 was filed for modification of the order dated 24.01.2024 passed in Cr. Misc. No. 180 of 2024, which was allowed vide order dated 09.08.2024 and two weeks further time was granted to the petitioner to surrender and

No.68264 of 2024(2) dt.20-09-2024 2/2 furnish bail bond subject to deposit of a sum of Rs. 2000/- before the District Legal Service Authority, Patna, but due to communication gap, the petitioner could not surrender within the extended time. He, accordingly, prays for further one week time to surrender before the learned District Court.

Having regard to the submissions made on behalf of the petitioner, by way of last chance, let the time granted by this Court to surrender before the learned court below by order dated 24.01.2024 passed in Cr. Misc. No. 180 of 2024 be extended by further one week from today subject to the condition that the petitioner shall deposit a sum of Rs. 4,000/- before the District Legal Services Authority, Patna.

5. Accordingly, this application is allowed to the extent indicated above.
